i just call pre to start with

as played i probably ch behind evaluate

but i really dont like 3bet here cos CO/BTN r shorts so we can flat call of them,
also i dont like to 5bet alll in if guy 4bets and i dont like to fold if he 4bets so...

sorry I didn't give enough information that was stupid of me.

I played a certain hand before, where he was HJ and I 3bet vs him from CO, basically same 3bet size. He was setmining oop with 44 in a 3bet spot, and we weren't really deeper. So I was 3betting because I think (and saw) that he's capable of calling here with a lot of lower pairs as well.

This. I don't mind setmining in his shoes OOP preflop (yet I feel 3bet/folding 99 here against me is a massive leak IMO). If he's passive/fishy preflop we can take this line with 99, planning on 3bet/folding.
