It depends on the villain, but if you 3bet I would go for it against a 44bb stack.
If villain is tight I would just call and her-evaluete the flop.

First of all - its 100% 3bet preflop cause on 40bb you should never be afraid to get it in. Reason is simple - odds.
You can fold only if villain is stacking super tight range - against something like AQ+,88+ you have easy call and recrationals tend to go looser than this.
