Hi guys I have a bit weird question -
Is it possible to register yourself as self employed by playing poker as gambling winnings are not taxable in UK??(
Just need to fill a small gap in my employment status for the past 3 months.
So that's what I came up with actually say the truth of what I have been doing and do it legally if possible. Cuz I do have actual winnings for the period .
I don't know anything about it cuz I have never been self-employed and I mean literally nothing about it. So please be detailed in answers ♦
Gambling doesn't constitute a trade, profession or vocation and is non taxable so there is no need to register winnings even if you could. Why not just say for last 3 months you have lived off personal savings if questioned further you can explain poker winnings you had online.Read the following article it might explain what you need to know.
It is not the case mate although, thanks for the answer and the link.
Really helpful.
Case is that, I actually need them months in employment, like official.
So, I've spoken with some pple, it could be done.
I just need to ring HMRC tomoz, just to be sure, cuz today I gave up after a 40+min on hold.
Not sure If I have to do self assessment cat 2 or 4 cuz, I think it comes to a non taxable cat. where you can voluntary pay towards pension and NINO, but not sure. just read some stuff today.
I'll add more info about it tomorrow in case smne else needs to go thru smntg like this.
But could be done in conclusion, I reckon.
I'm not sure what sort of job you're applying for, but a gap of 3 months between jobs could most believably be filled in as "job search".
Since you're applying for a job, it appears that the job search was successful.
If you were not actually self employed, listing yourself as "self-employed" may be construed as a "material mis-statement on your application" which would disqualify you immediately. Think of that awkward moment in the interview when they ask for details about your business.
Another thought just zoomed through my mind:
If they're going to be so absurdly picky that they want a 3-month gap in your employment history filled, then do you really want to work for them?
Note that I used to manage a department at a printing plant and was involved in the hiring of several people over my career there. I don't recall ever looking at the gaps in a resumé -- just the experience, the duties and the accomplishments.
In Italy there was a case of a pokerpro of Eastern European origin who tried to be recognized as a poker player to justify his standard of living and to have a residence permit but is unemployed and has no right to a permit to stay. Living room.
Right, I rang HMRC today and was told I can't open a sole trader as winnings are not taxable and was told I can voluntary pay towards my National Insurance.
But agent didn't sound very convincing and he took lots of time to research. ( I bet he most likely never heard such thing before ♦ lol)
So I'll speak with an accountant as well just to double check.

It's not the case. I'll just say it : It is for SFE, I'm getting student finance but I'm under section of migrant workers cuz I'm in UK for less than 5 years and one of the requirements is to be in employment or self-employment all the time. So my 3 month gap may cost me a few thousands. Even-though they said in email they'll consider the current COVID situation and lock down ...but still.:f_confused:
See I'm not trying to cheat, I'm trying to say the truth what I've been doing past 3 month. I'm prepared with 4K+ winnings over the period, graphs and transactions between poker rooms. Was just thinking is there a way to actually do it legally.
I'm actually expecting to start a job in April so my point was that in those 3 moths I haven't been lying in my bed I was actually doing something
recognised as a profession.
But now I'm starting to think that it doesn't work that way.
Plus on the other hand I'm thinking that SFE won't have a good opinion about my gambling activity at all, regardless of graphs and etc,. :Dlol
So It really could be a bad Idea, I'm still thinking about it.

That is perceptive.
Although it is generally respectable enough, earning a living by gambling is still poorly regarded by some.
I love this quote:
Ambrose Bierce
The gambling known as business looks with austere disfavor upon the business known as gambling.
Hi,
Just spoke with an accountant that's been recommended to me as very good one.
She basically laughed about that whole thing.
So answer is NO you can't pay taxes over a thing that the income of it is non-taxable, and you can't open a sole trader for an activity that is not a trade, a service etc,.
She strongly advised me not to present it to SFE as a profession, as it won't be recognised, and even if it does rise some exception of a rare case(by any chance), It would be very questionable in many other terms.(like for example if provided funding has been used for gambling activities)
So basically she said you can keep your graphs for yourself lol
I was given another advise for my case, which won't comment over the internet, as it is a fraud in my eyes. And I'm not doing it anyways.
So I'll just write a good explanation and keep fingers crossed for me that my evidence will go through a merciful and understanding advisor
lol
PS: Here is a bit of a lough about this guy in 2014 that's been hoping his poker winning over the past 2 years to serve as proof of income for a mortgage

So there are craziest people than me after all

Thing with poker is it's only proof of past winnings it's not proof of future earnings so it's very doubtful a bank manager is going to base financial decisions for the future on what someone won last year or last five years at poker.

The warning that "past performance does not predict future earnings" or similar wording appears prominently on every Mutual Fund investment description in Canada.
(see my quote previously)
They allow professional ̶g̶a̶m̶b̶l̶e̶r̶s̶ investors get mortgages, but not professional poker players.
A flat, incomes/savings, possibly a bank account, and registering for the stay. Incomes are a fuzzy area, rarely an issue. Permits are temporary, that's all, and if one must, one can leave the country periodically. If one can partly buy a flat, if the country has such deals, it is one of the sure ways to get a flat.
